These Terms of Service ("Terms") govern your use of the Teacher's App (Aplikacja Nauczyciela, the "App") mobile application provided by Maciej Bernacki (the "Developer"). By installing or using the App, you accept these Terms. If you do not agree with any part of them, do not use the App.
Using the App requires an Android device, a Google Play account, and — for AI-based features (generating day plans, stories and songs, narration, illustrations) — an active internet connection. Some features, such as viewing saved content, also work offline.
The App is a planning and storytelling tool for adults who look after young children: early-childhood teachers planning for their groups, and parents who use its parent mode (presented as Parent App) to plan for their own children at home. It enables the creation of day plans, stories and songs using artificial-intelligence models, with optional narration, illustrations, and video export. These Terms cover both.
AI-generated content is provided as suggestions and may contain errors, inaccuracies, or material unsuitable for a particular situation. The Developer does not warrant the correctness, completeness, or fitness for purpose of generated content. You are responsible for independently reviewing and assessing every generated item before using it with children. Pedagogical and parenting decisions remain the sole responsibility of the user.
If any generated content appears offensive, harmful, or otherwise inappropriate, you can flag it without leaving the App using the "Report this content" option available on generated content. Reports are reviewed by the Developer and inform content moderation; what a report transmits is described in the Privacy Policy.
The Developer grants the user a non-exclusive, non-transferable license to use the App for their own professional, educational, or personal and family purposes. The following are prohibited:
The App is available in a free tier with a limited number of content generations and with advertisements served via Google AdMob. Current free-tier limits are shown in the App and may change. To protect against abuse, the Developer may use verification mechanisms (including Google Play Integrity) and server-side limits.
The App offers paid subscriptions (including Premium and Premium Plus) in monthly and yearly variants. A subscription unlocks additional features such as no ads, unlimited plan generation, and — depending on the variant — a periodic allotment of tokens used for audio features (e.g. narrated stories and songs) and other premium functions.
The App also offers one-time audio-token packages — consumable purchases that add tokens to your balance and require an active subscription to use. Tokens (whether from a subscription allotment, a package, or a promotion) have no monetary value, are non-transferable and non-refundable once consumed, and are tied to the installation that earned or purchased them.
The scope and limits of each variant (including token amounts and the rules for granting and validity of tokens) are described in the App and may change; users will be informed of material changes.
The App may offer a referral programme in which recommending the App can earn bonus tokens for both the inviter and the new user. Rewards are granted only for genuine new installations that meet the conditions shown in the App, and are subject to anti-abuse verification and limits. Creating artificial installations, using emulators or automation, or otherwise farming referrals is prohibited, and the Developer may withhold or revoke rewards obtained that way. The programme's availability, rates, and conditions may change or end at any time; already-credited token balances are not taken away when they do.
All payments are handled exclusively by Google Play Billing; the Developer does not process your payment data. A subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before it ends. The fee for the next period is charged to your Google Play account. One-time token packages are charged once and do not renew.
You can cancel anytime in the Play Store app (Subscriptions). After cancelling, you keep Premium access until the end of the paid period. Changing a variant (e.g. monthly to yearly, or between tiers) follows Google Play's rules.
Consumers have the right to withdraw from a distance contract within 14 days under applicable consumer law. For digital content and services — including subscriptions and token packages — this right expires once performance has begun with the consumer's express consent and acknowledgment of the loss of the withdrawal right. Refunds and payment-related complaints are handled under Google Play's policies.
Complaints about the App's operation can be sent to bernacki.dev@gmail.com and should include a description of the problem, your device model, and the App version. The Developer will respond within 14 days. Payment-related complaints should be directed to Google Play.
The App, its code, interface, logo, and materials (excluding content generated for the user) are the property of the Developer and are protected by law. Content you generate with the App (day plans, stories, songs, narrations, illustrations, exported videos) may be used for your own professional, educational, or personal and family purposes.
The App is provided "as is". To the fullest extent permitted by law, the Developer is not liable for damages arising from the use of AI-generated content or from decisions made on its basis. This provision does not exclude or limit consumer rights under mandatory law.
Data processing is described in the Privacy Policy, which forms an integral part of these Terms.
The Developer may amend these Terms for valid reasons (e.g. feature changes, legal requirements, or changes to service conditions). The current version is always available at this address, with the last-updated date shown above. Continued use of the App after changes take effect constitutes acceptance.
Matters not regulated here are governed by Polish law, without prejudice to mandatory consumer-protection provisions. Consumers may use out-of-court complaint mechanisms, including the EU ODR platform: ec.europa.eu/consumers/odr.
